Experience & expertise
Neil has extensive experience of judicial review proceedings and has regularly advised in relation to reviewing the decisions of tribunals including decisions made by the Registrar of the MPTS and orders requiring a doctor to give evidence at hearings.
Most recently he has advised on the ability of health professionals to challenge the decisions of the Parliamentary and Health Service Ombudsman. He also has a wealth of experience in relation to the judicial review of coroners’ decisions.
In the field of information law, Neil has extensive experience in relation to advising on the effect of the Access to Health Records Act 1990 and the Data Protection Act 1998, acting for example for an NHS trust in a case concerning the disclosure of a deceased patient’s medical records.
He has also appeared before the Information Tribunal in appeals relating to the Freedom of Information Act 2000 and also before Crown Courts in relation to public interest disclosure applications. More recently he has resisted claims brought by individuals in relation to covert surveillance under the Regulation of Investigatory Powers Act 2000 and has appeared before the Investigatory PowersTribunal.
