James Berry appears in urgent Human Tissue Act case

James Berry appeared on behalf of an off duty doctor who came to the assistance of a severely injured person on the street and became covered in her blood in the process. The injured person sadly died and it was therefore impossible to obtain her consent to undertake blood / tissue testing to ascertain whether she was suffering from any blood borne diseases that may have infected the doctor. A relative was located and Mr Justice Cobb accepted the relative’s consent as being valid for the purposes of the strict terms of the Human Tissue Act 2004. Fortunately, the testing revealed that the deceased was not carrying any blood borne diseases.
