Dijen Basu QC, Elliot Gold and James Berry in the Court of Appeal on discrimination case

On 7 January 2022 the Court of Appeal handed down its judgment in Eckland v Chief Constable of the Avon and Somerset Constabulary.

The case considered whether, when members of a police misconduct hearing panel are alleged to have unlawfully discriminated against a police officer appearing in front of them, liability under the Equality Act 2010 should rest with the panel or with the Chief Constable of the police force in question.

Dijen and Elliot represented the Chief Constable in the ET, the EAT and the Court of Appeal.

James represented the National Association of Legally Qualified Chairs as an intervener in the Court of Appeal, acting pro bono.

The Chief Constable has applied for permission to appeal to the Supreme Court.
