Judgment handed down in Oxfordshire County Council v P and G [2026] EWCOP 33 (T2)

HHJ Owens, sitting in the Court of Protection, has handed down judgment in Oxfordshire County Council v P and G [2026] EWCOP 33 (T2).
The case concerned the health and welfare of P, a young lady with diagnosed learning difficulties and who has suffered significant childhood trauma. The fundamental dispute before the court was whether it was in P’s best interests to continue to live in her supported living placement or return to live with her Grandmother.
Of wider interest, following the Supreme Court’s decision in AGNI [2026] UKSC 16, this case is an example of the court applying the new multifactorial approach in order to determine if either package of care proposed amounted to the deprivation of P’s liberty: see paras 11, 14, 16-18, and 46.
The court also gave guidance as to the proper approach that should be taken when making applications for participation measures for the benefit of witnesses due to give live oral evidence: see para 8.
