Record £6.5m fine imposed for breaches of health and safety legislation – Alexander do Santos prosecutes for Office for Rail and Road

On 30 July 2021, the Northampton Crown Court sentenced WH Malcom Limited, which runs one of the biggest rail freight depots in Britain, to a fine of £6.5m for breaches of health and safety regulations. This is believed to be the largest health and safety fine imposed in two decades. The case resulted from the tragic death of an 11-year-old boy, and was prosecuted by Alexander dos Santos of Serjeants’ Inn Chambers, led by David Travers QC of 6 Pump Court Chambers instructed by the Office for Rail and Road.
