Matthew Holdcroft successfully defended the Lancashire Constabulary against allegations of race and sex discrimination.
The case involved a white, male officer that had been subject to a misconduct investigation and subsequently dismissed for misconduct (press coverage of the misconduct hearing is available here). The Claimant, submitted that the investigation had discriminated against him and that a female BAME officer should have also been subject to an investigation at the same time, and they should have appeared at a joint hearing together.
The Employment Tribunal agreed with Matthew that there had not been any less favourable treatment. They also agreed that the Respondent’s treatment of the Claimant was entirely attributable to the allegation that had been made against him.
As a result the claim was dismissed in its entirety.
