Amardeep Dhillon appears in the Court of Appeal

Amardeep Dhillon (led by Philip Moser KC), instructed by Aisha Wardell of Acuity Law, appeared in the Court of Appeal yesterday in Braceurself v NHS England.
The significant issues in this appeal are the correct interpretation of Fraser J’s guidance as to the application of the Francovich factors to a claim in damages in procurement law, in circumstances where a single manifest error has been found to have prevented the Appellant bidder from being awarded the contract. It is the first time that an appellate Court has had the opportunity to consider Fraser J.’s judgment in Energy Solutions EU Ltd v Nuclear Decommissioning Authority [2016] EWHC 3326 (TCC).
