Anthony Haycroft successfully defends Consultant Gastroenterologist in a 2-week alleged sexual assault by touching case

Anthony Haycroft successfully defended a Consultant Gastroenterologist before a Medical Practitioners Tribunal in a 2-week case of alleged sexual touching dating back 15 years. The doctor could not recollect the patient but as she had complained on the day of the examination he had made a contemporaneous account of events as he recollected them. The police had investigated and so there were numerous witness statements from hospital staff at the time and forensic examination evidence. The doctor’s case was that he only performed a normal abdominal examination appropriate for her gastric complaint. The complainant gave evidence in person as did the doctor. The MPT accepted the defence submissions as regards numerous inconsistencies in the patient’s account. As a result the MPT found that the GMC had failed to prove their case and found none of the allegations concerning his alleged touching proven. As such no misconduct or impairment were found.
