EMPLOYMENT

Our silks and juniors practise across all aspects of employment law and the team acts for a wide variety of clients, advising on both contentious and not contentious matters. We appear for Claimants and Respondents, in the Employment Tribunal, the EAT, the County Court, the High Court and the appellate courts as well as the range of ADR forums.

Many, but by no means all, of our employment cases relate to the healthcare and police sectors in which we are well-known specialists.

We have particular expertise in:

  • discrimination – we regularly appear in long and complex claims of discrimination, victimisation and harassment of all kinds (sex, race, disability, age, sexual orientation, religion or belief);
  • termination of employment – we act in all cases of unfair dismissal, constructive dismissal, wrongful dismissal and redundancy from individual self-selecting redundancies to large scale redundancies with collective consultations affecting hundreds of employees across a number of different sites;
  • whistleblowing – we represent clients in a wide range of whistleblowing cases;
  • equal pay, TUPE and pensions – we have particular expertise in the areas of public sector pensions and in particular NHS and police pensions;
  • regulated employment – the employment team has particular expertise and a specialist understanding of both the complex employment relationships and the commercial and policy issues within the healthcare and Police sectors;
  • injunctions – the employment team has significant experience of obtaining and resisting injunctions to require compliance with contractual terms and restrictive covenants in the High Court;
  • contractual disputes and bonus claims – we advise and represent clients in all forms of commercial employment law including the breadth of disputes relating to contracts of employment and bonus litigation whether in the Employment Tribunal or the High Court; and
  • human rights – we have experience across the range of human rights litigation and of the impact of human rights law on employment relations. We regularly advise our public sector clients on compliance with their employees’ Convention rights including broader human rights topics such as of data protection, confidentiality and employee surveillance.
