Overview

Jemma has experience of acting for the official solicitor, CCGs, NHS Trusts and local authorities in Court of Protection proceedings. She has acted in cases concerning deprivation of liberty safeguards, welfare and best interests decisions, and medical treatment.

Court of Protection

CD v An NHS Trust: Jemma acted for an NHS Trust in an application by the family as to the residence of CD. It was ordered that it was in CD’s best interests to remain within the NHS Trust.

MJ v An NHS Trust: Jemma acted on behalf of an NHS Trust that had subjected MJ to a standard authorisation and was in the process of discharge planning. The need for discharge planning was disputed by the family.

AM v A Local Authority: Jemma acted for the Official Solicitor in a claim concerning a challenge to a standard authorisation. Final declarations were made at the hearing as to where AM should reside.

AL v A CCG: Jemma acted on behalf of a CCG in proceedings concerning the best interests of AL who could not return home to live with her sister due to concerns regarding her safety.

SWJ v A Local Authority: Jemma acted for the local authority in a matter concerning the best interests of a lady with severe learning disabilities.
